By accessing or using the Divyscribe platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms apply to all users, including Clients (those who upload files for transcription) and Transcribers (those who provide transcription services). Additional terms may apply to specific features or services.
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance of the modified Terms.
To use the Service, you must create an account and provide accurate, complete information. You are responsible for:
You must be at least 18 years old to create an account. Accounts are non-transferable and may only be used by the registered individual or authorized representatives of a registered business entity.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for extended periods.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may NOT:

Client Content: Clients retain all rights to the audio, video, and other content they upload ("Client Content"). By uploading content, Clients grant Divyscribe and assigned Transcribers a limited license to access, process, and store the content solely for providing the Service.
Transcription Work: Upon Client approval and payment release, the Client receives full rights to the completed transcription. Transcribers may not retain, distribute, or use completed transcriptions for any purpose other than their original intended use on the platform.
Confidentiality: All users agree to maintain strict confidentiality of content processed through the Service. Transcribers must not disclose, share, or discuss any content with third parties.
Platform Content: The Divyscribe platform, including its design, code, logos, and documentation, is owned by Divyscribe and protected by intellectual property laws.
Credit System: Divyscribe operates on an internal credit system. Clients purchase credits to pay for transcription services. Transcribers earn credits for approved work.
Pricing: Clients set their own payment rates per minute of audio. A platform service fee is added to each job. Current fee structures are displayed during the upload process.
Escrow: When a Client uploads a job, sufficient credits are held in escrow. Credits are released to the Transcriptionist upon Client approval. If no review occurs within 7 days, automatic approval releases the payment.
Payouts: Transcribers receive automatic weekly payouts every Tuesday for work approved by Sunday. No manual withdrawal process or minimum threshold required.
Refunds: Credits may be refunded under limited circumstances as outlined in our Refund Policy. Completed and approved work is generally non-refundable.
Disputes between Clients and Transcribers should first be resolved through our internal dispute system:
Decisions by administrators are final within the platform. Users retain all legal rights to pursue external remedies in accordance with applicable law.
For legal disputes with Divyscribe itself, you agree to first attempt resolution through informal negotiation by contacting us at legal@divyscribe.com. If unresolved within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIVYSCRIBE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
Our total liability for any claim arising from the Service shall not exceed the greater of: (a) the amount you paid to Divyscribe in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Divyscribe does not guarantee the quality of transcription work performed by Transcribers. Clients are responsible for reviewing and verifying all transcription output before use.
Voluntary Termination: You may close your account at any time through your Settings page or by contacting support. Upon termination:
